Beyond Horizons – Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Beyond Horizons’s Services.
By using our Services, whether as a guest, a registered user, or otherwise, you agree that these Terms will govern your relationship with Beyond Horizons (“Beyond Horizons,” “we,” “us,” or “our”). These Terms apply to all users of the “Beyond Horizons Network,” which is defined as, but not limited to:
The Beyond Horizons Minecraft server(s) and associated services,
The beyondhorizons.net website and official portals,
All games, mini-games, worlds, features, and components accessed through the server or website,
All features, functionalities, and related content connected to the above.
If you do not completely agree to these Terms of Service, you must not use any of our Services.
1) Definitions
“Account” means any account provided by Beyond Horizons that you create to access certain Services.
“Dispute” means any controversy arising out of or relating to this agreement, including, without limitation, any aspect of the relationship between you and Beyond Horizons, whether such claims arise before, during, or after the termination of this agreement, except for claims related to the enforcement of Intellectual Property Rights.
“In-Game Purchases” means purchases available for purchase through the Services.
“Intellectual Property Rights” means all rights related to copyrights, trademarks, trade secrets, patents, and similar proprietary rights, whether registered or not.
“Notice” means a communication delivered in writing by email, courier, or by registered delivery to the other party at their given address and will be effective upon receipt.
“Privacy Policy” means Beyond Horizons’s privacy policy, which governs your use of the Services and is incorporated by reference.
“Service” (or “Services”) means the Beyond Horizons Network and any other website, game, platform, device, content, and other related products or features provided by Beyond Horizons and Beyond Horizons Affiliates.
“Terms of Service” (or “Terms”) means the terms and conditions described in this agreement.
“User Content” means any content that you upload, transmit, or create through the Services.
“Beyond Horizons Affiliate” means third-party content providers, distributors, licensors, or licensees associated with Beyond Horizons.
2) Ownership and Limited License
a) Ownership
The Services are owned or licensed by Beyond Horizons and are protected by Intellectual Property Rights and other laws. Beyond Horizons reserves all rights not explicitly granted to you in these Terms.
b) License
Subject to your agreement and continued compliance with these Terms, Beyond Horizons grants you a non-commercial, non-exclusive, non-transferable, revocable, limited license to access and use the Services for your own entertainment purposes.
c) Accounts
You may access the Beyond Horizons server through your Minecraft account (“Account”), and you agree to be bound by these Terms. If you share an Account, this agreement applies to all users of that Account.
Beyond Horizons may permanently delete Accounts that are deemed inactive. Accounts are considered inactive when they have not been used for 180 days.
You acknowledge that if your Account is deleted, you may lose access to any information associated with that Account.
If you wish to delete your Account, you must contact Beyond Horizons Support.
d) License Limitations
Your limited license is subject to the following restrictions. You agree that you will not directly or indirectly:
- Engage in conduct that Beyond Horizons determines is against the spirit or intent of the Services;
- Use cheats, hacks, exploits, bots, scripts, or any gameplay methods not expressly authorized by Beyond Horizons;
- Use automation software, reverse-engineering tools, or unauthorized third-party software to access, manipulate, or disrupt the Services;
- Distribute or promote tools, modifications, or software that facilitate cheating or gain an unfair advantage;
- Exploit the Services for unauthorized commercial purposes, including but not limited to:
- Selling in-game items or currency outside the Services,
- Providing paid account boosting or leveling,
- Advertising or soliciting services through the Services without approval;
- Organize, promote, or participate in gambling or wagering activities related to the Services;
- Create or use in-game items generated or copied through bugs, errors, or undocumented features;
- Copy, modify, or distribute materials from the Services except as expressly authorized;
- Rent, sell, lease, or exploit for commercial purposes any part of the Services;
- Delete, obscure, or alter any proprietary notices or marks;
- Harass, threaten, abuse, or harm any person, group, or entity, including Beyond Horizons staff or affiliates;
- Organize or participate in any activity that is hateful, harmful, or offensive toward protected classes;
- Initiate or assist in any attack or disruption to the Services, including malware, denial-of-service, or other harmful acts;
- Attempt to access accounts or services that do not belong to you;
- Use the Services where prohibited by law.
Violation of these limitations may result in immediate revocation of your license, account deletion, or legal action, at Beyond Horizons’s discretion.
3) Payment and In-Game Purchases
In-Game Purchases are owned by Beyond Horizons and are not your property. Beyond Horizons may modify, control, or eliminate any In-Game Purchase at any time, without notice or compensation.
ALL CHARGES ARE FINAL AND NON-REFUNDABLE, except as required by applicable consumer rights laws. You will not receive compensation for unused purchases if your Account is closed.
If refunds are provided, they are at Beyond Horizons’s sole discretion and under limited conditions.
4) User Content
Beyond Horizons is not responsible for conducting prior screening of User Content. Your use of the Services is at your own risk.
When you upload User Content, you agree that:
- It is accurate, complete, and free of fraud,
- It does not infringe any third-party rights,
- It is free from harmful or illegal content,
- It complies with these Terms.
- You grant Beyond Horizons a worldwide, royalty-free, perpetual, irrevocable, transferable license to use, reproduce, modify, display, and distribute your User Content.
- Beyond Horizons does not claim ownership of your User Content but may use it without compensation.
DMCA and Copyright
If notified of copyright infringement, Beyond Horizons may terminate access to infringing content. Notice to Beyond Horizons must include:
- Identification of the copyrighted work,
- Identification of the infringing material,
- Contact information,
- A statement of good-faith belief of infringement,
- A signature by the authorized rights holder.
5) Term
Unless modified by Beyond Horizons, this agreement remains in effect. Termination of your license does not affect the remaining Terms.
6) Account Access
If you have been previously banned from any Beyond Horizons Services, you may not access or use the Services.
7) Service Availability and Termination
You acknowledge that:
Beyond Horizons may modify, update, or discontinue any part of the Services at any time.
Beyond Horizons may suspend or terminate access at its discretion, without notice or liability.
You may terminate these Terms at any time by ceasing use of the Services.
Access to Services may be interrupted for reasons beyond our control.
Upon termination or suspension, all virtual items, progress, or purchases are forfeited, and you are not entitled to refunds.
The Services may not be available in all regions.
8) Warranty and Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BEYOND HORIZONS DISCLAIMS ALL WARRANTIES.
BEYOND HORIZONS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
YOUR SOLE REMEDY IS TO STOP USING THE SERVICES.
IF YOU HAVE PAID ANY AMOUNT IN THE 180 DAYS PRIOR TO A CLAIM, THE MAXIMUM LIABILITY SHALL NOT EXCEED THAT AMOUNT.
Some jurisdictions do not allow limitations on certain warranties or liabilities; in such cases, limitations apply to the maximum extent permitted by law.
9) Indemnity
You agree to indemnify and hold harmless Beyond Horizons, its affiliates, and personnel from any claims, damages, losses, or expenses arising out of:
Your violation of these Terms,
Your use of the Services,
Any harmful software or conduct you cause.
10) Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction where Beyond Horizons is based, without regard to conflict of laws principles. You agree to resolve disputes in the applicable courts unless prohibited by local law.
11) Changes to These Terms
Beyond Horizons may update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
