Beyond Horizons Terms of Service

Welcome to Beyond Horizons, a Minecraft Survival (SMP) server. These Terms of Service ("Terms") are a binding agreement between you ("you," "the player," or "user") and Beyond Horizons ("we," "us," "the server," or "the network"). By connecting to the server, joining our Discord, or making a purchase from our store, you agree to these Terms in full. If you do not agree, do not connect to or use the server.

Beyond Horizons is not affiliated with, endorsed by, or associated with Mojang AB, Microsoft, or any of their subsidiaries. Minecraft is a trademark of Mojang AB. Your use of the Minecraft client is also governed by the Minecraft End User License Agreement (EULA), which you must comply with at all times while playing here.

1. Eligibility

1.1. You must own a legitimate, paid copy of Minecraft to play on Beyond Horizons. Cracked, pirated, or unauthorized clients are strictly prohibited.

1.2. There is no strict minimum age to play, but if you are under the age of 13 (or the minimum digital-consent age in your country), you should only play with the permission and supervision of a parent or legal guardian. Any purchase made by a minor must be authorized by a parent or guardian who accepts these Terms on their behalf.

1.3. You are responsible for all activity that occurs on your account, whether or not you authorized it. Do not share your account credentials with anyone.

2. Acceptance and Changes to These Terms

2.1. By playing on the server, you acknowledge that you have read, understood, and agreed to these Terms, our in-game rules, and any additional guidelines posted in our Discord or on our website.

2.2. We may update these Terms at any time. Material changes will be announced in our Discord and reflected in the "Last updated" date above. Continued use of the server after changes take effect constitutes acceptance of the revised Terms.

2.3. It is your responsibility to review these Terms periodically.

3. Player Conduct and Rules

You agree to follow all server rules. The list below is not exhaustive; staff may act on behavior that harms the community or the server's integrity even if it is not explicitly listed here.

3.1. Prohibited Software and Cheating

  • No hacked clients, cheats, X-ray texture packs, X-ray mods, or any modification that grants an unfair advantage.
  • No macros, auto-clickers, or automation tools that simulate player input to bypass gameplay (e.g., AFK farming past what the server allows).
  • No exploiting bugs, glitches, or duplication methods. If you discover a bug or exploit, you must report it to staff immediately rather than using it. Abusing exploits may result in the removal of illegitimately obtained items and account penalties.

3.2. Survival / SMP Gameplay Conduct

  • Griefing (destroying, altering, or defacing another player's builds without permission) is prohibited.
  • Stealing from other players' chests, storage, or claimed land is prohibited.
  • Respect land claims and protected regions. Do not attempt to bypass claim or protection systems.
  • Do not build offensive, hateful, or inappropriate structures, signs, or pixel art.
  • Do not intentionally lag the server (e.g., excessive redstone, entity, or hopper contraptions designed to cause performance damage).
  • Trapping, scamming, or luring players in bad faith may be treated as griefing depending on context and severity, as determined by staff.

3.3. Chat and Communication

  • No harassment, bullying, threats, hate speech, slurs, or discrimination of any kind (including on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, or age).
  • No spamming, excessive caps, or flooding chat.
  • No sexually explicit, graphic, or otherwise NSFW content.
  • No advertising other servers, services, or products.
  • No sharing of another person's private or personal information ("doxxing").
  • English is the recommended language in public chat so staff can moderate effectively; check server-specific guidance for language channels.

3.4. Accounts and Fair Play

  • No alternate accounts ("alts") used to evade punishments, abuse rewards/votes, or gain unfair advantages. Legitimate alt use may be permitted only where server rules explicitly allow it.
  • No impersonating staff members or other players.
  • No attempting to gain unauthorized access to other accounts, staff permissions, or server systems.

3.5. Real-World Trading

  • Trading in-game items, ranks, currency, or accounts for real-world money or goods outside of the official Beyond Horizons store is prohibited and done entirely at your own risk. We do not recognize, support, or reimburse such trades.

4. Enforcement and Punishments

4.1. Staff may issue warnings, mutes, kicks, temporary bans, or permanent bans at their discretion based on the severity and history of the offense.

4.2. Punishments are issued in good faith to protect the community. Staff decisions are made using the best information available and are considered final unless successfully appealed.

4.3. We reserve the right to remove any player from the server at any time, for any reason, with or without notice. Access to the server is a privilege, not a right.

4.4. Illegitimately obtained items, currency, or progression may be removed at any time without compensation.

4.5. Ban evasion (attempting to rejoin using another account, IP, or identity while banned) will result in extended or permanent penalties.

5. Appeals

5.1. If you believe a punishment was issued in error, you may submit an appeal through:

5.2. Appeals should be respectful and include your in-game name, the punishment received, and the reason you believe it should be reviewed. Abusive, spam, or repeated appeals may be denied without review.

5.3. Submitting an appeal does not guarantee a punishment will be lifted or reduced. All appeal decisions are final.

6. The Beyond Horizons Store, Purchases, and Payments

6.1. Beyond Horizons offers optional purchases (such as ranks, cosmetics, crate keys, and other virtual items) through our official store, which is operated and processed via Tebex (Overwolf/Tebex Ltd.), our authorized payment and webstore provider. Purchases are completely optional and are not required to play. Your purchase is also subject to Tebex's Terms of Service and Buyer Terms, in addition to these Terms.

6.2. Nature of purchases. All purchases are for non-tangible, virtual, in-game items and privileges. You are not buying ownership of any item, currency, or data. Instead, you are purchasing a limited, revocable license to use that virtual content on the server for as long as the server chooses to make it available.

6.3. Legitimate payment only. You may only purchase using a payment method that you own or are authorized to use. Fraudulent payments, stolen payment methods, or purchases made without the account holder's permission are strictly prohibited. All payments are handled securely by Tebex and its supported payment processors; Beyond Horizons never receives or stores your full card or banking details.

6.4. Delivery. Purchased items are typically delivered automatically through Tebex within a few minutes. If an item is not delivered, contact us via Discord or email before disputing the charge, and we will resolve it.

6.5. Price and availability changes. Prices, perks, and item availability may change or be discontinued at any time. Purchasing an item does not guarantee it will remain available, unchanged, or functionally identical in the future. Purchases do not exempt you from these Terms or the server rules.

7. Refunds and Chargebacks

7.1. All purchases are final and non-refundable, except where a refund is required by applicable law or granted at our sole discretion.

7.2. Chargebacks and payment disputes are strictly prohibited. If you have a problem with a purchase, you must contact us first through Discord or email, or raise it with Tebex support, so we can attempt to resolve it before any dispute is filed.

7.3. Initiating a chargeback, PayPal dispute, or payment reversal will result in:

  • Immediate and permanent suspension of your account and access to the server;
  • Removal of all purchased and in-game items, ranks, and currency associated with your account; and
  • Possible blacklisting from future purchases and access.

7.4. Access previously purchased may be revoked without refund if you violate these Terms or the server rules.

8. Content and Ownership

8.1. Server content. The Beyond Horizons name, logos, custom plugins, configurations, builds provided by the server, and other original content are the property of Beyond Horizons and its creators. You may not copy, redistribute, or commercially exploit them without permission.

8.2. Your content. By building, chatting, or otherwise contributing content on the server, you grant Beyond Horizons a non-exclusive, royalty-free, worldwide license to host, display, store, reproduce, and use that content for the purposes of operating and promoting the server (for example, in screenshots, trailers, or social media). You retain any rights you already hold in your original creations.

8.3. You are solely responsible for the content you create or share, and you confirm you have the right to share it.

9. Data and Privacy

9.1. To operate the server, we may collect and store limited data such as your Minecraft username and UUID, IP address, in-game activity and statistics, chat logs, punishment history, and, for store purchases, information processed by our third-party payment provider (we do not store full card details ourselves).

9.2. This data is used for gameplay, moderation, security, anti-cheat, and support purposes. We do not sell your personal data.

9.3. Payments are processed by Tebex and its supported payment providers (such as PayPal, Stripe, and card processors), whose own terms and privacy policies apply to the payment transaction. Tebex acts as the merchant of record for store purchases.

9.4. If you would like your data reviewed or removed where applicable, contact us via Discord or email. Some data (such as punishment records) may be retained where necessary to maintain server integrity and security.

10. Server Availability and "As-Is" Disclaimer

10.1. Beyond Horizons is provided "as is" and "as available." We do not guarantee that the server will be available at all times, uninterrupted, error-free, or free of data loss.

10.2. We are not liable for any loss of in-game items, progress, ranks, currency, or purchased content resulting from server downtime, crashes, rollbacks, resets, bugs, exploits, third-party actions, or discontinuation of the server or any game mode.

10.3. We reserve the right to reset worlds, wipe data, or shut down the server or any game mode at any time. Where reasonably possible, we will provide advance notice of major resets or closures, but this is not guaranteed.

11. Limitation of Liability

11.1. To the fullest extent permitted by law, Beyond Horizons, its owners, staff, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, items, currency, or purchases, arising from your use of or inability to use the server.

11.2. To the extent liability cannot be excluded, our total liability to you for any claim relating to the server or these Terms shall not exceed the total amount you paid to Beyond Horizons in the six (6) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Beyond Horizons and its staff from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your violation of any law, or your infringement of any third party's rights.

13. Third-Party Services

Beyond Horizons may reference or integrate third-party services (such as Discord, Tebex, payment processors, voting sites, or hosting providers). We are not responsible for the content, policies, or actions of those third parties, and your use of them is governed by their own terms.

14. Termination

14.1. We may suspend or terminate your access to the server and store at any time, with or without notice, for any reason, including violation of these Terms.

14.2. Upon termination, your right to access the server and any purchased or in-game content ceases immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and refund/chargeback provisions) will continue to apply.

15. General

15.1. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.2. No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

15.3. Entire agreement. These Terms, together with our posted rules and any store-specific terms, constitute the entire agreement between you and Beyond Horizons regarding your use of the server.
